Hence, this Petition for Review on certiorari.
After trial the court a quo rendered judgment with the following dispositive portion:
(5) Ordering both defendants to pay the costs jointly and severally.
ART. 1403. The following contracts are unenforceable, unless they are justified:
Articles 1930 and 1931 of the Civil Code provide the exceptions to the general rule afore-mentioned.
To support such argument reference is made to a portion in Manresa's Commentaries which We quote:
Teehankee (Chairman), Makasiar, Fernandez and Guerrero, JJ., concur.
